CIC-LUX SARL

1. Eligibility & Scope

1.1. This offer is exclusively available to residential properties located within Luxembourg.
1.2. The property must have a minimum listing price of €450,000.
1.3. Commercial and rental properties are excluded from this offer. CIC-LUX SARL has separate offers available for these property types.
1.4. This offer is only available to clients selected by CIC-LUX SARL and is subject to an exclusive sales mandate signed between the property owner(s) and CIC-LUX SARL, which must be registered with the designated institution.
1.5. CIC-LUX SARL reserves the right to modify or withdraw this offer at any time without prior notice.


2. Commission Structure & Offer Details

2.1. The 1%, 2%, and 3% commission tiers include different levels of service. CIC-LUX SARL reserves the right to adjust the service details within each commission tier without prior notice, provided it does not affect active contracts.
2.2. The seller must select a commission tier after a consultation with a CIC-LUX SARL sales representative, who will explain the terms and conditions.
2.3. The commission is fixed at the selected tier upon signing the exclusive mandate and cannot be negotiated further, unless agreed upon by CIC-LUX SARL.


3. Seller Responsibilities & Exclusivity

3.1. The seller must provide all legal documents required for the sale, including but not limited to ownership certificates and property diagnostics.
3.2. If CIC-LUX SARL covers the cost of an energy passport, the document remains the property of CIC-LUX SARL unless purchased by the seller.
3.3. Exclusivity Clause:

  • The seller cannot sell the property privately or through another agency.
  • If a buyer contacts the seller directly after seeing an advertisement from CIC-LUX SARL, the seller must direct them back to the agency.
  • The full commission remains payable to CIC-LUX SARL, even if the seller sells to a close relative or friend.

4. Cancellation, Penalties & Modifications

4.1. Cancellation terms are outlined in the exclusive sales mandate signed by the property owner and CIC-LUX SARL.
4.2. If the seller withdraws the property from sale after signing the exclusive mandate before the term date, CIC-LUX SARL may impose penalties up to €10,000, plus interest for delayed payments in accordance with the European Union’s conditions on delayed payments.
4.3. The commission is due upon the notary deed if the property once the property is sold to the new owners. No delays to this payment may be applied. Penalties due to delays are applicable and enforcable.


5. Privacy & Data Protection

5.1. CIC-LUX SARL adheres to the General Data Protection Regulation (GDPR) and will not sell or share personal data (including names, phone numbers, and emails) with third-party companies.
5.2. Personal data collected through this offer is used solely for communication and transaction purposes related to the property sale.


6. Legal Jurisdiction & Dispute Resolution

6.1. Luxembourg law exclusively governs this agreement.
6.2. Disputes must first be attempted to be resolved amicably between the parties before initiating legal proceedings.
6.3. If a dispute is taken to court without prior attempt at resolution, the property owner or signee may be liable for legal fees and lost costs incurred by CIC-LUX SARL.


7. Final Provisions

7.1. CIC-LUX SARL reserves the right to modify these Terms & Conditions at any time. Changes will not affect signed agreements but may apply to future clients.
7.2. By signing the exclusive mandate, the seller agrees to these Terms & Conditions and acknowledges that they have read and understood them.
